He’ll walk for four years

A FOUL-mouthed man who crashed his car in Upper Beaconsfield and refused a police breath test after going on a birthday bender has been banned from driving for four years.
Daniel Boyes had driven his car off Stoney Creek Road, knocking over a Give Way sign and a commercial sign near the entrance of Cardinia Beaconhills Golf Links on 27 June.
Police found an unharmed and apparently “alcohol affected” Boyes leaning on the vehicle and throwing his keys on the road, Dandenong Magistrates’ Court was told on 28 November.
An unfinished bottle of spirits was observed in the car.
When asked for a breath sample, the accused told two police officers they were “t**s and c***s”.
He also argued that someone else had driven the car – which was owned by him, and that the officers were acting against “international copyright law”.
As police persisted another four times for Boyes to submit a sample, he started playing on his phone.
A “belligerent” Boyes then asked one of the officers: “Do you have a c***?”
He was then taken to Narre Warren police station.
When interviewed by police at his address two weeks later, Boyes said he had been “out of it” and in a “state of shock and intoxication”.
He failed to attend court on the matter in July and August.
Magistrate Pauline Spencer said Boyes faced a mandatory minimum driving disqualification of four years due to a prior drink-driving conviction in 2012.
When asked to explain his “very drunk” behaviour, Boyes told the court he met up with people on his birthday and couldn’t explain how he drove as far as he did on the night.
He told the court he shouldn’t have had access to a car when drinking, and would ensure there was no repeat.
The unemployed man was also fined $500.
